Public land management and plans

Council has ownership of a number of land parcels across the Ballina Shire.  Council also has the responsibility for the care, control and management of various Crown land parcels.  Details of these land parcels are contained in Council’s Land Register.

Council has the care, control and management responsibility for the following categories of land:


Community Land

Land owned by Ballina Shire Council may be classified as “community land” in accordance with the requirements of the Local Government Act 1993.  Community land is for general public use and includes land such as a public parks.

Current Proposals to Lease Community Land

Ballina Shire Council is proposing to enter into a Lease Agreement for occupation of land classified under the Local Government Act 1993 (“the Act”) as ‘community’ land. The details are as follows:

Lennox Community Gardens Inc

Location: Lennox Community Gardens, Part of Lot 31 DP787876 Ocean Breeze Reserve, Ocean Breeze Drive, Lennox Head

Purpose: Operation and management of a community garden

Term: 3 years

Lennox Head Cricket Club Inc

Location:  part of Lot 74 DP 774896 - 20 Megan Crescent, Lennox Head

Purpose: Sports clubhouse

Term: 3 years

Alstonville & District Cricket Club Inc

Location: part of Lot 267 DP1209571 Wollongbar Hall (garage area), 25 Simpson Avenue, Wollongbar

Purpose: Storage of sports and gardening equipment

Term: 3 years

Submissions close: 4.30pm Wednesday 8 April 2020

As the above land is classified as Community Land, and in accordance with the provisions of the Local Government Act, interested persons are invited to make a written submission with respect to the granting of the Lease Agreement. Where a submission is an objection, the grounds of objection must be specified. All submissions, including personal information, will become publicly available and will be made available to the applicant and interested members of the public. Submissions may be included in Council’s business paper and provided to the Minister for Local Government.

Operational Land

Land owned by Ballina Shire Council may be classified as “operational land” in accordance with the requirements of the Local Government Act 1993. Operational land serves a variety of purposes that relate to Council carrying out its functions.


Crown Land Managed by Council

There are a number of Crown reserves where Ballina Shire Council has been appointed reserve trust manager.  Council has management responsibility for such land in accordance with the requirements of the Crown Lands Act 1989. Please refer to our Council Documents page for current plans of management. 


Crown Land Devolved to Council

Council has management responsibility for certain Crown reserves as specified in section 48 of the Local Government Act 1993.  These reserves are said to be “devolved” to Council.


Crown Land Leased by Council

Council has management responsibility for several parcels of Crown land as leaseholder.


Land Register

Under section 53 of the Local Government Act 1993 Council is required to keep a register of all land vested to it or under its control.  An extract of Council’s land register is provided via the link below.
