Annual Financial Statements - 30 June 2023

The Annual Financial Statements to 30 June 2023 together with the draft Auditor’s Report were presented for consideration to the 26 October 2023 Ordinary Council meeting.

In accordance with Section 418 (3) of the Local Government Act 1993 (NSW), Ballina Shire Council advises that the Ordinary Council meeting to be held on 23 November 2023 will include the formal presentation of the audited Financial Statements and the Auditor’s Reports for the year ending 30 June 2023.

In accordance with Section 420 of the Local Government Act 1993 (NSW), submissions in writing are invited with respect to the Council’s audited financial Statements of the Auditor’s Reports.

Ballina Shire Development Control Plan 2012

Amendment related to Dual Occupancy (Attached) Development at Wollongbar

Council adopted amendments to Ballina Shire Development Control Plan 2012 (the DCP) at its Ordinary Meeting held on 26 October 2023.  The amendments to the DCP will take effect from 3 November 2023.

The DCP amendments include the following changes:

  • Chapter 2 – Incorporate a reference to Wollongbar within the Note in Part 3.5 Land Slip / Geotechnical Hazard.
  • Chapter 3 – Incorporate a reference to Wollongbar within Table 3.1 in Part 3.2.1 Minor Subdivision Control Elements: Element G: Minimum Lot Size and Shape for the Built Form Dual Occupancy (Attached).
  • Chapter 4 – Incorporate a reference to Wollongbar within Table 4.6 in Part 3, Element N – Minimum Lot Area and Width, for the Type of Residential Accommodation – Dual Occupancy (Attached).

  • North Ballina moving from B Ward to A Ward (previously exhibited for public comment)
  • All areas in the Newrybar locality west of the Pacific Motorway moving from B Ward to C Ward (previously exhibited for public comment)

Ballina Shire Development Control Plan 2012 (BSDCP2012)

Amendment of Chapter 3 Urban Subdivision

Council adopted amendments to the Ballina Shire Development Control Plan 2012 (the DCP) at its Ordinary Meeting held on 24 August 2023.  The amendment to the DCP will take effect from 8 September 2023.

The amendments consist of the following changes:

  • Chapter 3 – Appendix B - Amendments to the Ballina Heights Structure Plan – Village centre relocation

Proposed Changes to Ward Boundaries

Ballina Shire Council is proposing changes to the ward boundaries for the upcoming local government elections to ensure equitable representation.

In accordance with the NSW Local Government Act, there should be no more than a 10% variance in the number of electors between each Council ward. However, based on the latest census figures, the number of electors in B Ward exceeds this limit compared to C Ward.

To rectify this variation, the Council proposes reallocating several properties from B Ward to either A or C Ward. This adjustment aims to ensure a balanced representation of electors across all wards.

The Ballina Shire is divided into three wards:

A Ward: Majority of Ballina township, South Ballina, and surrounding rural areas.

B Ward: East Ballina to Lennox Head and surrounding rural areas.

C Ward: Alstonville/Wollongbar/Wardell and surrounding rural areas.

If the proposed changes are implemented, voters will vote for candidates in either A or C Ward instead of B Ward in the next local government elections. Please note that the Mayor is popularly elected, allowing all electors in the local government area to participate in electing the Mayor.

Draft Development Servicing Plans - Water, Wastewater and Recycled Water Infrastructure

Ballina Shire Council has prepared TWO draft Development Servicing Plans (DSPs) for:

  1. Water Supply Infrastructure
  2. Wastewater and Recycled Water Infrastructure.

Under the Local Government Act 1993 and Water Management Act 2000, Council can levy developer charges for water, wastewater, and stormwater infrastructure. 

These plans outline the charges applicable to this infrastructure in Ballina Shire, following the 2016 Developer Charges Guidelines for Water Supply, Sewerage, and Stormwater issued by the Minister for Land and Water Conservation. 

Objectives of the DSPs: 

  • Provide adequate water, wastewater, and recycled water infrastructure for new developments.
  • Establish a fair and comprehensive strategy for assessing, collecting, and accounting for contributions.
  • Avoid placing the financial burden of new infrastructure on the existing community due to future development.
  • Ensure transparency and financial accountability in the assessment and administration of the DSPs.

Proposed Changes to Ward Boundaries

Ballina Shire Council is proposing changes to the ward boundaries for the upcoming local government elections to ensure equitable representation.

In accordance with the NSW Local Government Act, there should be no more than a 10% variance in the number of electors between each Council ward. However, based on the latest census figures, the number of electors in B Ward exceeds this limit compared to C Ward.

To rectify this variation, the Council proposes reallocating several properties from B Ward to either A or C Ward. This adjustment aims to ensure a balanced representation of electors across all wards.

The Ballina Shire is divided into three wards:

A Ward: Majority of Ballina township, South Ballina, and surrounding rural areas.

B Ward: East Ballina to Lennox Head and surrounding rural areas.

C Ward: Alstonville/Wollongbar/Wardell and surrounding rural areas.

If the proposed changes are implemented, voters will vote for candidates in either A or C Ward instead of B Ward in the next local government elections. Please note that the Mayor is popularly elected, allowing all electors in the local government area to participate in electing the Mayor.

BSDCP 2012 Development Control Plan Review

Ballina Shire Development Control Plan 2012 (BSDCP2012) proposed amendments.

Council resolved to amend the Ballina Heights Estate Structure and Landscape Plans at its meeting on 22 June 2023. The amendments will align with proposed zoning changes associated with the relocation of the Ballina Heights Neighbourhood Commercial Centre.

The Ballina Heights Estate Structure and Landscape Plans are contained in Appendix B to Chapter 3 - Urban Subdivision of BSDCP 2012.

The DCP amendments are on exhibition from Tuesday 4 July to Tuesday 1 August 2023.

Ballina Shire Development Control Plan 2012 - Amendment No. 16 – Various Housekeeping Amendments

Council adopted Amendment No.16 to the Ballina Shire Development Control Plan 2012 (the DCP) at its Ordinary Meeting held on 25 May 2023.  Amendment No. 16 to the DCP will take effect from 2 June 2023.

Amendment No. 16 includes the following changes:

  • Chapter 3 – Amendments to the Ballina Heights Structure Plan in response to a landowner request to remove the area previously designated for a retirement village, to be replaced by standard residential lots.
  • Chapter 4 – Additions to Section 3.1.3, clarifying that in relation to measurement of building lines on properties adjacent to a foreshore/waterway feature or asset, the building line is measured from the lot boundary fronting that feature or asset.
  • Chapter 7 – Addition of a new section on agritourism, addressing the recent State Government legislative amendments which facilitate farm stay accommodation, farm experience premises, and farm gate activities in all rural zones throughout the State.
  • Various chapters – update references to business and industrial zones and environmental protection zones to reflect the State Government ‘Employment Zones’ reform, and the renaming of ‘Environmental’ zones to ‘Conservation’ zones.

Note: Council did not adopt changes to the Fig Tree Hill Neighbourhood Map which also formed a part of the exhibited proposed DCP Amendments.

This advice is provided in accordance with Clause 20 of the Environmental Planning and Assessment Regulation 2000.

Alstonville Cemetery Draft Master Plan

The master plan for Alstonville Cemetery has been refreshed in line with user feedback and future needs. The Alstonville Cemetery Draft Master Plan 2023 outlines the future expansion of the cemetery into a practical long-term vision, which:

  • determines the capacity and potential lifespan of the cemetery for future burials and niche interments
  • guides the physical development and growth of the cemetery in an efficient manner, addressing operational and maintenance needs.

Some key features of the plan include:

  • Increased cemetery capacity across a variety of interment types (1,172 lawn burial plots, 688 columbarium wall niches, 293 garden memorial allotments). This should increase capacity to approximately 43 years.  
  • Incorporation of double lawn burial beams which allow for wider vehicle access and improved circulation.
  • A designated ceremony area including a small shade structure.
  • A vehicle turn-around area on Alstonville Cemetery Road and signage identifying private land.
  • Vegetation management and signage within Alstonville Cemetery Road reservation to improve overflow parking. 
  • Weed tree removal and replacement with native species.
  • Seating throughout the cemetery.
  • Marking of a designated accessible car parking bay linked with accessible path to the ceremony area.
  • Improved wayfinding signage and interpretative signage

Alstonville Cemetery will remain a low-key and peaceful environment where the heritage and natural features of the site and context predominate.

The NSW Disability Inclusion Act 2014 requires all councils in NSW to prepare a new Disability Inclusion Action Plan (DIAP) every four years.  The Draft Ballina Shire Council DIAP 2023-2026  is Council’s second DIAP and builds upon the success of the previous plan.

The draft DIAP 2022-2023 sets out actions that Council will undertake to help build an inclusive and accessible community that meets the needs of its residents and visitors regardless of ability.

Ocean Breeze Reserve

Ballina Shire Council is preparing to implement additional components of the adopted Ocean Breeze Reserve Master Plan.

Before implementing the next stage of work, we are seeking community feedback on a Tree Management Plan developed for the proposed vegetation management works from the Ocean Breeze Reserve Master Plan.

The proposed works will involve pruning and removing weeds and exotic and native species to improve the health and amenity of vegetation on the reserve.  The works will also see additional trees and landscaping planted to enhance shade and the recreational value of the park.

Council has also progressed the detailed design for the nature play-based playground in preparation for construction. The playground has been designed based on community feedback received during the development of the adopted master plan.

BSCPP 21/002 - Ballina Heights Commercial Centre Relocation

This planning proposal seeks to amend the Ballina Local Environmental Plan 2012 to relocate the neighbourhood commercial centre within the Ballina Heights Estate, in Cumbalum.

The planning proposal will achieve this by:

  • Applying the B2 Local Centre zone to an area of land currently zoned R3 Medium Density zone (Pt Lot 667 DP1280013).
  • Applying the R3 Medium Density Residential zone to parts of the area currently within the B2 Local Centre zone (Pt Lot 497 DP1261230).
  • Retain the B2 Local Centre zone to an area of land currently zoned B2 Local Centre zone in parts of the site that are unsuitable for residential zoning by virtue of proximity to road noise from the Pacific Highway.
  • Consequential amendments to the Minimum Lot Size map, Height of Buildings map and Floor Space Ratios map in line with the changes in zoning

Note:

  1. After 26 April 2023 the B2 zone will be replaced with an E1 Local Centre zone as part of zone name changes made by the Department of Planning and Environment.
  2. Council has been authorised as the local plan-making authority and has been given delegation by the Department of Planning and Environment to make the local environmental plan (s3.36(2) of the Environmental Planning and Assessment Act 1979).

Illegal Dumping and Litter Prevention Strategy

Ballina Shire Council seeks to reduce the incidence of illegal dumping and littering across the Shire.

Council's vision is to: "see a decrease of 10% in illegal dumping incidents in Ballina Shire by the year 2028"

Council is committed to protecting the local environment and community by reducing the amount of litter and its social, environmental, health and financial impacts.

Council’s objective as outlined in this Strategy is to create anti-littering behaviour in the Ballina Shire through an integrated approach of education and awareness, infrastructure, enforcement and monitoring and evaluation.

Local data on illegal dumping and littering as well as research and other strategies have informed the development of this Strategy.

BSDCP 2012 Development Control Plan Review

Council resolved to place on public exhibition draft amendments to BSDCP2012. The main amendments are as follows:  

  • Chapter 3 – Amendments to the Ballina Heights Structure Plan in response to a landowner request to remove the area previously designated for a retirement village, to be replaced by standard residential lots.
  • Chapter 4 – Additions to Section 3.1.3, clarifying that in relation to measurement of building lines on properties adjacent to a foreshore/waterway feature or asset, the building line is measured from the lot boundary fronting that feature or asset. 
  • Amendment to the Fig Tree Hill Neighbourhood Map to include lots fronting Coopers Close and to notes in Chapter 2 (Section 3.11.3) and Chapter 7 (Section 4.2) to advise that dual occupancy development is not supported in the mapped area due to insufficient sewerage capacity.
  • Chapter 7 – Addition of a new section on agritourism, addressing the recent State Government legislative amendments which facilitate farm stay accommodationfarm experience premises, and farm gate activities in all rural zones throughout the State.
  • Various chapters – update references to business and industrial zones and environmental protection zones to reflect the State Government ‘Employment Zones’ reform, and the renaming of ‘Environmental’ zones to ‘Conservation’ zones.

BSCPP 22/007 Proposed Rezoning of Land

In October last year, Council resolved to rezone land at Burns Point Ferry Road, West Ballina.  The land, located at the corner of River Street and Burns Point Ferry Road and extending along the western side of Burns Point Ferry Road, is known as Lot 1 DP 124173 and has an area of approximately 56 hectares.

The northern part of the land is currently zoned R2 Low Density Residential, with the southern part zoned RU2 Rural Landscape.

Council’s proposal is to rezone the land to C2 Environmental Conservation, other than a small area located in the north-east corner, which would stay as R2 Low Density residential.

The decision to change the site’s zoning follows a previous Development Application for a manufactured home estate on the land, which was refused by the NSW Land and Environment Court in late 2021.  The Court found that residential development as proposed would have unacceptable impacts on the land’s high environmental values.  This judgement has formed the basis of Council’s decision to rezone the site.

Document on Exhibition

Ballina Shire Council resolved at its 24 November 2022 Meeting to place the following document on exhibition for public comment:

Following a review of existing Strategic Urban Growth Areas (SUGAs), Council has prepared a planning proposal to amend maps that form part of Ballina Local Environmental Plan 2012.

SUGAs are areas not yet zoned for urban development that, at a broad strategic level, have potential to accommodate longer-term future urban growth.

A SUGA designation does not seek to rezone land, nor does it provide certainty for any future rezoning. Rather, it signals that Council is of the view that further detailed investigation of land for urban potential may be appropriate at some future date.

More importantly, the SUGA designation prevents the land from being developed for a use that might jeopardise its future urban potential, through the application of clause 7.8 of BLEP 2012.

Conservation Zone Review - Planning Proposal BSCPP 21/004

Council has prepared a planning proposal to amend the Ballina Local Environmental Plan (LEP) 2012 to transition deferred matter land (other than deferred land that has an existing environmental protection zone under the Ballina LEP 1987) into the Ballina LEP 2012 by applying appropriate zones, including conservation zones (C zones).

The planning proposal also seeks to amend clause 41(2) of the Ballina LEP 1987 by reducing the maximum period for which land can be used for a temporary use from 52 days to 14 days, consistent with the temporary use provisions contained within the Ballina LEP 2012.

All landowners whose properties are affected by a proposed zoning change are being contacted directly via letter. Affected landowners are invited to speak to Council officers about the proposed changes on their property and to provide feedback.

Document on Exhibition

Ballina Shire Council resolved at its 24 November 2022 Meeting to place the following document on exhibition for public comment:

Council is updating the Plan of management for publicly owned community land throughout the Shire.

Community land refers to land dedicated for use by the general public.

The draft Plan of Management will govern the use of community land owned by Council as well as Crown Land which is managed by Council, with the exception of land within the Ballina Coastal Reserve, Hampton Park in Ballina and Williams reserve in Lennox Head.

Separate Plans of Management will be developed for those reserves.

The draft Community Land Plan of Management 2023 will replace the 2015 Plan and outline the basis for managing the various Council-owned and managed properties.

As required by the Local Government Act 1993, the draft Plan categorises all community land as either:

  • Park – for areas primarily used for passive recreation.
  • Sportsground – for areas where the primary use is for active recreation involving organised sports or the playing of outdoor games.
  • General community use – for all areas where the primary purpose relates to public recreation and the physical, cultural, social, and intellectual welfare or development of members of the public.  This includes venues such as community halls, scout and guide halls, and libraries.
  • Natural area – for all areas that play an important role in the area’s ecology.  This category is further subdivided into bushland, escarpment, foreshore, watercourse and wetland categories.

Management measures are outlined in the draft Plan for each of these categories

Proposal: Development of a Two Storey Building containing Child Care Centre (maximum capacity of 114 children) and Bakery in three stages - involving the partial demolition of and alterations and additions to an existing building (demolition of the existing hairdresser premises and retention of the existing bakery), demolition of an structure containing three residential units, demolition of an existing child care centre and construction of a new two storey child care centre, removal of vegetation, earthworks (cut and fill and retaining walls), vehicular access, infrastructure works, car parking, acoustic barrier, landscaping and land consolidation.

Any person may make a submission in writing to Council.  Where a submission is by way of objection the grounds of objection must be specified in the submission.  All submissions, including any personal information contained therein, will become publicly available documents and will be made available to the applicant and any other interested members of the public.  They may also be included in Council’s business paper.  If you do not wish your submission to be publicly available you must provide Council with written reasons for this.  Alternatively, you may wish to provide an anonymous submission.  However, anonymous submissions may be given less (or no) weight in the overall consideration of the proposal.
