Flat Rock Tent Park Fees and Charges 

Council resolved at its meeting of 15 December to exhibit the proposed 2023/24 fees, booking and cancellation policy for Flat Rock Tent Park for the period of 1 February 2023 to 31 January 2024. New fees are exhibited for public comment prior to introduction, as required by Section 610F(3) of the Local Government Act.

Planning Proposal BSCPP 22/004 – General Amendments 2022

Following a periodic ‘housekeeping’ review of the Ballina Local Environmental Plan 2012 (the LEP), Council has prepared a planning proposal to amend the LEP to improve the interpretation and accuracy of the plan.  The amendment relates to two separate issues as summarised below:

  • Ascot Road, Ballina: Amend the Height of Building (HOB) standard from 8.5m to 10m for lots on the northern and southern side of Ascot Road, Ballina to provide consistency with the 10m HOB standard applicable to the adjacent Southern Cross Industrial Estate.
  • Clause 7.5 Airspace operations: Amend the wording of the clause to remove the requirement for consultation with the relevant airport authority in relation to proposed residential development in existing planned residential areas.

Council has been authorised as the local plan-making authority and has been given delegation by the Department of Planning and Environment to make the local environmental plan (s3.36(2) of the Environmental Planning and Assessment Act 1979).

Richmond River Estuary - Draft Scoping Study on exhibition

Northern Rivers councils are taking a whole-catchment approach to develop a new long-term strategy to protect and improve the health of the Richmond River estuary. Once complete, the Coastal Management Program (CMP) will include actions to restore and maintain the ecological sustainability of the Richmond River estuary.

Hydrosphere Consulting has now prepared a draft Stage 1 Scoping Study and they are asking for the community's feedback.

The Study identifies knowledge gaps and outlines how the new CMP will be developed and the community engagement process.

Ballina Shire Development Control Plan 2012 – Amendment No. 15

Council adopted Amendment No. 15 to the Ballina Shire Development Control Plan 2012 (the DCP) at its Ordinary Meeting held on 27 October 2022.  Amendment No. 15 to the DCP will take effect from 9 November 2022.

Amendment No. 15 provides for various housekeeping updates to some DCP Chapters, including updates to:

  • legislation references to accord with recent changes to State Environmental Planning Policies,
  • clarify the development application lodgement and assessment processes, and
  • introduce controls associated with recently adopted policies such as koala habitat management and biodiversity offsets.

Amendment No. 15 includes the following changes:

  • Chapter 1 – Administration - Updates to Development Application lodgement and process.
  • Chapter 2 – General and Environmental Considerations – a new section for Koala Habitat Management, including updated mapping; minor update to Council’s Public Art policy.

We observe the National Day of Mourning for Her Majesty The Queen on Thursday 22 September 2022.

The following council services will be closed on Thursday:

  • Waste Management Centre & The Salvage Shed (bins will be collected as usual on public holidays. Please have bins kerbside by 5am on your normal collection day, as start times and the order of collection may vary)

Ballina Shire Open Spaces and Community Facilities Contributions Plan 2022

Council resolved at its Ordinary Meeting held on 28 July 2022 to adopt the Ballina Shire Open Spaces and Community Facilities Contributions Plan 2022.  The plan comes into effect from 29 July 2022. 

The primary purpose of the plan is to authorise:

  • the Council, when granting consent to an application to carry out development to which this plan applies; or
  • a registered certifier, when issuing a complying development certificate for development to which this plan applies,

to require a section 7.11 contribution to be made towards the provision, extension or augmentation of open space, recreation and community facilities that are required because of development, or that were provided in anticipation of, or to facilitate, such development.

The plan’s other purposes are:

  • To provide a clear and transparent basis for levying contributions under the provisions of section 7.11 of the Environmental Planning and Assessment Act 1979.
  • To provide the framework for the efficient and equitable determination, collection and management of open space and community facilities development contributions.
  • To establish the relationship between the expected development and proposed facilities to demonstrate the required contributions are reasonable.
  • To update the assumptions underpinning the previous plan (Ballina Shire Open Space and Community Facilities Contributions Plan 2016).
  • To allow for facilities in this plan to be provided by developers as works in kind in lieu of a monetary contribution.
  • To provide for the dedication of land at no cost to Council in lieu of a monetary contribution.
  • To ensure that the broader Ballina community is not unreasonably burdened by the provision of open space and community facilities that are required because of development in the Shire.

Ballina Shire Open Space and Community Facilities Contributions Plan 2022

Ballina Shire Council has prepared a new developer contributions plan known as the Draft Ballina Shire Open Space and Community Facilities Contributions Plan 2022.  

The draft contributions plan has arisen from a review of the Ballina Shire Contributions Plan 2016.  The draft plan includes the following:

  • A works schedule with a total value of $80 million, of which a portion is to be met by contributions levied on development.
  • A schedule of contribution rates for different development types.
  • Information on how the contribution rates were calculated.
  • Provisions enabling reasonable contributions to be imposed on development.
  • Council’s policies on how and when developers can settle their contributions obligations, including opportunities for developers to provide land and works ‘in kind’.
  • Specific provisions on the role of accredited certifiers in imposing and collecting development contributions.
  • Various other provisions related to the fair and transparent administration of Section 7.11 contributions for open space and community facilities.

It is proposed that the new contributions plan will apply to all development approved following the adoption of the plan.

The schedule of works identified in the plan has been compiled on the basis of an Open Spaces and Community Facilities Needs Study, which accompanies the exhibition.

Code of Meeting Practice (Review)

Ballina Shire Council resolved at its 26 May 2022 Meeting to exhibit the draft Code of Meeting Practice for public comment.

This document includes mandatory provisions included in the local government regulations. This code outlines how Council meetings are conducted and aims to support effective meeting procedures.

A code of meeting practice must be adopted no later than 12-months after a Council election.

Strategic Urban Growth Area Review (draft)

Ballina Shire Council resolved at its 26 May 2022 Meeting to exhibit the draft Strategic Urban Growth Area Review.

As part of the Council’s planning for the future, a number of areas have been identified as potential urban development rezoning.

These areas are collectively known as Strategic Urban Growth Areas and their identification ensures that realistic longer-term growth areas are available across the Ballina Shire.

Council's current planning indicates there is enough land zoned for urban development to cater for approximately 20-years of growth, so there is no intention to rezone these Strategic Urban Growth Areas for urban development in the short term. 

Most of the Strategic Urban Growth Areas were identified a long time ago, under different planning environments, and the potential suitability of some areas has been impacted by other projects and major civil works, notably the Pacific Highway upgrade. Therefore it is important we continue to review each of the areas to ensure their realistic long-term potential.

2032 Community Strategic Plan and Delivery Program

Council has prepared the draft 2032 Community Strategic Plan. This is a 10-year plan prepared by Council on behalf of the community.

The CSP provides a broad overview of where we wish to head as a community and identifies the items that are important to us. It integrates with the four-year Delivery Program and one-year Operational Plan – these two documents provide specific actions, works and services that will be delivered in achieving the outcomes set out in the CSP 2032.

The Delivery Program for the four-year period from 2022/23 to 2025/26, which includes the draft Operational Plan for 2022/23, outlines:

  • Services and key actions planned
  • Summary of the major capital works scheduled
  • Our 10-year Long Term Financial Plan
  • Rates, charges and fees proposed for 2022/23.

Ballina Shire Development Control Plan 2012 – Amendments to Chapter 4 – Special Area Controls – The Avenue and Daley Street, Alstonville

Council adopted amendments to the Ballina Shire Development Control Plan 2012 (the DCP) at its Ordinary Meeting held on 24 February 2022.  The DCP amendment took effect from 25 March 2022.

The DCP amendment introduces Special Area Controls into Chapter 4 provisions relating to protection of existing residential character within an area located on the eastern side of The Avenue and the southern side of Daley Street, Alstonville.

This advice is provided in accordance with Clause 20 of the Environmental Planning and Assessment Regulation 2000.

The committee consists of three independent members, one of whom is the Chair, and two councillors as non-voting members.

Ballina Local Environmental Plan 1987 Amendments – BSCPP 21/006

Cawarra Park Master Plan

Ballina Shire Council is preparing a Master Plan for Cawarra Park in Ballina. This park is a district-scale sports and recreation facility, meaning it services the broader shire. Cawarra Park includes a sports field (baseball/softball), practice nets, a sports amenity building and non-powered watercraft storage facility (including dragon boats, outriggers and kayaks). Access to North Creek is available via the adjacent Crown Land. The study area for this Draft Master Plan (see below) excludes this strip of Crown Land which contains the public toilet block, carpark and boat ramp. It is intended that Cawarra Park retain a Tier 1 sporting function (meaning more traditional activities based on the provision of ovals, fields and courts) and remain a non-powered water sports hub.

The Draft Master Plan will consider how to renovate Cawarra Park to best address the current and future needs of stakeholders and the wider community. Proposed Road Closing Under Section 38B Roads Act 1993 - Section of River Drive (Hunter Street) Adjacent to 8 River Drive, East Wardell

Under the provisions of the Roads Act 1993, Ballina Shire Council proposes to close the following council public road.

The section of road under consideration comprises council public road adjacent to Lot 8 DP 1251184 at East Wardell.

Upon closing the road, Council intends to sell the land to the adjoining landowner.

Under the provisions of the Government Information (Public Access) Act, submissions may be referred to third parties for consideration.

Ballina Local Environmental Plan 2012

Planning Proposal BSCPP 21/005 – Lots 36-38 DP 1257681 Anchorage Avenue, Lot 1 DP 1239938, Hutley Drive, and adjoining road reserves, Lennox Head

Council has prepared a planning proposal to amend the Ballina Local Environmental Plan (LEP) 2012 to rezone and amend associated development standards with respect to Lots 36 – 38 DP 1257681, No. 2, 6 & 12 Anchorage Avenue, Lennox Head and Lot 1 DP 1239938, No. 133 Hutley Drive, Lennox Head and adjoining road reserves. 

The land to which this planning proposal applies involves four land parcels as shown outlined in red, and adjoining road reserves outlined in blue, in Diagram One below.  

With respect to Lots 36-38 DP 1257681 and adjoining road reserves, it is proposed to apply the R3 Medium Density Residential zone and to apply a minimum lot size of 450m2.  It is proposed to apply the B1 Neighbourhood Centre zone to the whole of Lot 1 DP 1239938 and to apply a minimum lot size of 800m2.

The planning proposal (BSCPP 21/005) will be on public exhibition between Thursday 27 January 2022 and Friday 11 February 2022 at:

  • Council’s Customer Service Centre between 8.30am and 4.30pm Monday to Friday (excluding public holidays)

Council has been authorised as the local plan-making authority and has been given delegation by the Department of Planning, Industry and Environment to make or not make the local environmental plan (s3.36(2) of the Environmental Planning and Assessment Act 1979).
